Abstract | Javna nabava je značajan političko-gospodarski sustav države u raspolaganju financijskim sredstvima namijenjenim nabavi robe, usluga i radova iz javnih programa i projekata. U ovom završnom radu objašnjen je postupak javne nabave u svim njegovim fazama, i to; istraživanje tržišta javne nabave, određivanje predmeta javne nabave, ponuda u javnoj nabavi, rok mirovanja, kao i završetak postupka javne nabave. Pojašnjen je pozitivni zakonodavni okvir u Republici Hrvatskoj kojim se osigurava transparentnost i pravednost u procesu javne nabave. U procesu javne nabave postoji i niz odredbi koji se odnose specifično na pravnu zaštitu ponuditelja, kao i žalbeni postupak u kojem Državna komisija za kontrolu postupaka javne nabave odlučuje o zakonitosti: postupaka, radnji, propuštanja radnji, odluka donesenih u postupcima javne nabave, o zakonitosti ugovora o javnoj nabavi i okvirnih sporazuma sklopljenih bez provedbe postupaka javna nabave. Na ovaj način ponuditeljima se jamči sigurnost i vjera u pravni sustav nabavnog postupka. Nadalje, definirano je značenje korupcije i sukoba interesa. Korupcija je zlouporaba povjerene moći radi postizanja privatne koristi, ali i svojevrstan sporazum između barem dva partnera i neka vrsta mita, plaćanja, pribavljanja imovinske ili druge koristi. Sukob interesa i korupcija nisu sinonimi iako često idu jedno s drugim pod ruku. Zbog svega navedenog neophodno jačati zakonske norme i pridržavati ih se kako bi mogli imati transparentnu, jednaku i učinkovitu tržišnu utakmicu između gospodarskih subjekata i drugih dionika postupaka javne nabave. |
Abstract (english) | Public procurement is an important political-economic system of the state in the disposal of financial resources intended for the procurement of goods, services and works from public programs and projects. In this final paper, the public procurement procedure is explained in all its stages, namely; research of the public procurement market, determination of the subject of public procurement, offer in public procurement, standstill period, as well as completion of the public procurement procedure. The positive legislative framework in the Republic of Croatia, which ensures transparency and fairness in the public procurement process, has been clarified as well. In the public procurement procedure, there are a number of provisions that refer specifically to the legal protection of bidders, as well as an appeals procedure in which the State Commission for Control of Public procurement Procedures decides on the legality of: procedures, actions, omissions, decisions made in public procurement procedures, on the legality of public procurement contracts and framework agreements concluded without implementation of public procurement procedures. In this way, bidders are guaranteed in security and faith in the legal system of the procurement procedure. Furthermore, the meaning of corruption and conflict of interest is also defined. Corruption is the misuse of entrusted power to achieve private benefit, but also a kind of agreement between at least two partners and some kind of bribe, payment, acquisition of property or other benefits. Conflict of interest and corruption are not synonymous, although they often go hand in hand. Due to all of the above, it is necessary to strengthen legal norms and adhere to them so that they can have a transparent, equal and efficient market match between economic entities and other stakeholders in public procurement procedures. |
