The Consumer Bankruptcy Act regulates the general rules on consumer bankruptcy, out- of- court proceedings before counseling centres, the presumptions for opening consumer bankruptcy proceedings, proceedings before a court, and the presumptions and effects of the consumer's exemption from the remaining obligations. The aim of this law is to exempt the honest consumer from the obligations that remain after the cashing of his assets and the distribution of the funds collected to creditors, he is relieving himself of the remaining liabilities. The fairness of the consumer shall be determined by the court taking into account the consumer's conduct before submitting a proposal for the opening of consumer bankruptcy proceedings, and his conduct during legal proce edings and the conduct review period. Consumer bankruptcy proceedings are carried out on the consumer's assets. Enforcement law regulates the procedure by which courts and notaries enforce the enforced exercise of claims on the basis of enforcement and authentic documents (enforcement proceedings) and the procedure by which courts and notaries carry out the insurance of claims (insurance procedures), unless otherwise specified by a specific law. The creditworthiness of consumers is also associated with the Enforcement Act, since the calculation of creditworthiness in banks is carried out precisely on the basis of the Enforcement Act. The Enforcement Act determines the minimum amount of salary that must remain after all debts, taking into account the average net salary in Croatia.
